Health-adjacent data under My Health My Data

Washington's My Health My Data Act protects consumer health data that falls outside HIPAA. The attorney general's guidance gives examples such as purchases of prescribed medication, data from apps that track bodily functions, and health inferences drawn from what a person buys. The guidance says the law generally applies to anyone doing business in Washington, or providing products or services to Washington consumers, who collects, processes, shares or sells that data. Selling it requires the consumer's valid authorization first, and a violation is a per se violation of the state Consumer Protection Act, enforceable by the attorney general and through private lawsuits.

For a fitness, wellness, retail or benefits app, that turns into design questions:

• →Which fields, events and inferences in the product count as consumer health data.
• →Where consent is collected, what it covers, and how a withdrawal flows through to every system holding the data.
• →Which analytics, advertising and AI services the data reaches, and whether any of that is a share or a sale.

On regulated builds we scope compliance and privacy requirements in the design phase, with your counsel deciding how the law applies. The answers then become data flows and consent screens in the build, not a policy page written afterwards.

AI features that run inside your cloud

Some Seattle companies cannot send data to a model provider's public API. We build with Anthropic's Claude and OpenAI models, called directly or through the client's own cloud when the data has to stay there, chosen per engagement. Every AI build starts with an evaluation set drawn from your own material, and it is re-run on every change, so a prompt edit or a model upgrade is measured before it ships. On agent builds, tools are allowlisted, irreversible actions wait for a person to approve them, and every tool call is logged.
